What HIPAA Requires for AI Memory

The practical requirements for an AI memory system storing PHI: encrypt all memory content with AES-256 or equivalent at rest, encrypt all data in transit with TLS 1.3, implement role-based access control that restricts PHI-containing memories to authorized clinical and administrative staff, maintain audit logs of every access to PHI-containing memories for 6 years, implement automatic session timeout for idle users, and support emergency access procedures for situations where normal access controls must be bypassed.

The Business Associate Agreement

If you use a third-party memory platform (rather than self-hosting), HIPAA requires a Business Associate Agreement (BAA) with the provider. The BAA establishes the provider's obligations for protecting PHI, including how they handle security incidents, what safeguards they maintain, and how they support your compliance obligations. The minimum necessary standard requires that access to PHI be limited to the minimum amount necessary for the user's job function. In an AI memory context, this means query results must be filtered not just by role but by the minimum set of memories needed to answer the current query. A nurse checking a patient's medication list should see medication-related memories but not billing-related memories about the same patient, even if both are accessible under their role.

Breach Notification Requirements

HIPAA's Breach Notification Rule requires that organizations report breaches of unsecured PHI. If AI memory containing PHI is accessed by an unauthorized party, whether through a system vulnerability, misconfigured access controls, or insider threat, the organization must notify affected individuals within 60 days, notify HHS (the Department of Health and Human Services), and for breaches affecting 500 or more individuals, notify prominent media outlets in the affected jurisdiction.

For AI memory systems, a "breach" includes scenarios that traditional database breaches do not cover. If a query returns PHI-containing memories to a user who should not have access due to an access control misconfiguration, that is a potential breach even though no external attacker was involved. If an AI agent's response to one user includes information derived from another patient's PHI-containing memories (through knowledge graph connections or embedding similarity), that is a potential breach through inference rather than direct access. These non-traditional breach vectors require monitoring that goes beyond perimeter security to include analysis of query results and AI-generated outputs.

The practical requirement is that your AI memory system must support breach investigation. When a potential breach is detected, you need to determine which specific memories were accessed, which patients' PHI was involved, when the access occurred, and whether the access was unauthorized. The audit trail must be detailed enough to answer these questions definitively, because "we are not sure which patients were affected" triggers worst-case notification obligations where you must assume all patients in the system were affected.

De-Identification as an Alternative

HIPAA's Safe Harbor method allows organizations to use health information without HIPAA restrictions if 18 specified identifiers are removed. If your AI memory system can store de-identified health information rather than PHI, many HIPAA requirements become inapplicable. The 18 identifiers include names, geographic data smaller than state, dates more specific than year, phone numbers, email addresses, Social Security numbers, medical record numbers, and device identifiers.

For AI memory in healthcare, de-identification at ingestion is practical for some use cases. A memory that says "a 45-year-old male patient with type 2 diabetes responded well to metformin titration" contains no identifiers and is not PHI under the Safe Harbor method. A memory that says "John Smith (MRN 12345) responded well to metformin titration" is PHI that requires full HIPAA protections. The most common HIPAA compliance failure in AI memory systems is storing PHI in a non-HIPAA-eligible service without realizing it. Not all cloud services are HIPAA-eligible, even within HIPAA-eligible cloud providers. AWS offers HIPAA-eligible services, but only the services listed in their BAA addendum. If your vector database or graph database runs on an AWS service that is not in the BAA, the PHI stored there is not covered, regardless of your encryption and access controls.

The second most common failure is treating embeddings as non-PHI. Because embeddings are numerical vectors rather than readable text, some organizations classify them as metadata or derived data rather than PHI. This classification is risky because research has demonstrated that embeddings can be inverted to approximate the original text, and regulators have signaled that derived data retaining the character of the original data inherits the original's protections.

The third failure is insufficient access logging granularity. HIPAA requires logs of who accessed PHI, but some AI memory implementations only log that a query was made, not which specific PHI-containing memories were returned in the results. An audit that reveals "user X made 500 queries in Q3" without showing which patient records were surfaced in the results does not satisfy HIPAA's access tracking requirements.
